The Good Lobby, as part of the Coalition Against SLAPPs in Europe (CASE), announces a significant development in the protection of freedom of expression within the European Union. On February 27, 2024, the European Parliament took a noteworthy step by voting in favor of the Anti-SLAPP Directive, a measure that establishes foundational standards for defending public watchdogs against Strategic Lawsuits Against Public Participation (SLAPPs).
Comprehensive Framework for Protection
This directive is a crucial policy that provides hope for journalists, civil society organizations, human rights defenders, and anyone engaged in holding power to account. It addresses the growing menace of SLAPPs – abusive litigations aimed at silencing critical voices through financial and psychological pressure rather than seeking justice.
The Directive outlines a comprehensive framework for Member States to develop national legislation that includes a broad spectrum of protections. This encompasses mechanisms for the early dismissal of baseless lawsuits, stringent criteria for damage compensation, and substantial penalties for those who misuse the legal system to intimidate.
A Call to Action for Effective Implementation
Additionally, it emphasizes the importance of non-legal instruments such as support mechanisms for those targeted, as well as training and awareness programs for legal practitioners.As we acknowledge this legislative milestone, we are aware of the journey ahead. The Directive serves as a foundation upon which Member States must now act to ensure its principles are translated into effective national laws. It’s a call to action for all Member States to strengthen their legal systems against misuse intended to suppress public discourse.
