The European Commission’s new “Omnibus” simplification package – aimed at rolling back parts of the Corporate Sustainability Reporting Directive (CSRD) and the Corporate Sustainability Due Diligence Directive (CSDDD) – is raising alarm among legal scholars and lawyers across Europe. In two legal opinions and an accompanying letter, over 100 signatories warn that Omnibus I may breach core EU principles: it lacks proper impact assessment, skipped full public consultation and may contravene the proportionality and fundamental-rights safeguards that underpin EU law. The letter urges MEPs to request an opinion from the Parliament’s Legal Service before taking further legislative action.
Authored by Professor Alberto Alemanno (HEC Paris) and David Frydlinger (CIRIO), the analyses argue the Omnibus is being used not for narrow technical fixes but for substantive rollbacks that could set a dangerous precedent for future legislation.
As Professor Alemanno warns in his opinion, “When speed and political convenience override procedural integrity, the EU signals that results matter more than legality and fundamental values.”
